These Terms of Business ("Terms") govern the provision of website design, hosting, and related services by WebFlux ("we", "us", "our") to you ("the Client", "you"). By instructing WebFlux to provide services, you agree to these Terms.

Keeping the website live and accessible

The exact scope of services will be based on the plan agreed with you.


2. Nature of the Service

WebFlux provides websites as a managed monthly service, not as a one-off purchase.

The website remains the property of WebFlux unless otherwise agreed in writing.

Continued access to the website is dependent on an active subscription.

If the subscription ends, the website may be taken offline.


3. Pricing & Payments

3.1 Monthly Fees

Services are charged on a monthly recurring basis.

Pricing depends on the plan selected and the services included.

Monthly fees are payable in advance.

3.2 Setup Fees

A setup fee may apply depending on the agreement.

Setup fees are non-refundable once work has commenced.

Setup fees may be waived at our discretion.

3.3 Price Changes

WebFlux reserves the right to adjust monthly pricing.

Any change to monthly pricing will be communicated with at least one (1) month’s notice.

Continued use of the service after the notice period constitutes acceptance of the new pricing.


4. Cancellation

This is a cancel-anytime service.

You may cancel your subscription at any time by providing notice via email.

Cancellation will take effect at the end of the current billing period.

No partial refunds are provided for unused time within a billing period.


5. Client Responsibilities

You agree to:

Provide accurate and lawful content (text, images, logos, contact details)

Ensure you have the right to use all materials supplied

Respond in a timely manner when information or approval is required

WebFlux is not responsible for delays caused by lack of client response.


6. Content & Accuracy

You are responsible for the accuracy of all content on your website.

WebFlux does not guarantee that website content is free from errors unless explicitly agreed.

We are not responsible for legal compliance of your content (e.g. industry regulations, claims, disclaimers).

 


7. Third-Party Services

WebFlux may use third-party tools, platforms, or hosting providers to deliver services.

We are not responsible for outages, errors, or changes caused by third-party providers.

Temporary downtime may occur due to maintenance or external issues.


8. Website Availability & Downtime

WebFlux aims to keep websites live and accessible but does not guarantee uninterrupted availability.

We are not liable for losses caused by downtime beyond our reasonable control.


9. Results & Guarantees

WebFlux does not guarantee specific results, including but not limited to: Increased sales Increased enquiries Search engine rankings Business growth

Websites are a marketing support tool, not a guarantee of performance.


10. Limitation of Liability

To the fullest extent permitted by law:

WebFlux shall not be liable for any indirect, incidental, or consequential losses.

Our total liability shall not exceed the total amount paid by you in the three (3) months preceding the claim.


11. Termination for Misuse

WebFlux reserves the right to suspend or terminate services if:

The website is used for unlawful purposes

Payment obligations are not met

There is abusive or unreasonable behaviour towards staff


12. Data & Privacy

We may store basic client information necessary to provide services.

We do not sell client data to third parties.

Clients are responsible for their own compliance with data protection laws related to website usage.


13. Amendments

WebFlux may update these Terms from time to time.

Updated Terms will be provided when changes are material.

Continued use of services constitutes acceptance of updated Terms.


14. Governing Law
